1. Agreement to Terms

By accessing or using the website pfendermarketing.com ("Site") operated by Pfender Marketing Co. ("PMC," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Site.

2. Services Overview

PMC provides digital marketing consulting services including SEO strategy and execution, paid media management, analytics and tracking, and web development. All services are performed by Joe Pfender as a sole operator unless otherwise disclosed.

3. Engagement and Scope

All service engagements begin with a discovery consultation. Specific deliverables, timelines, pricing, and scope of work will be outlined in a separate service agreement or statement of work ("SOW") provided prior to the commencement of any paid engagement. These Terms govern your use of the Site; the SOW governs the service relationship.

4. No Guarantees of Results

While we use industry best practices and draw on 10+ years of experience, we do not guarantee specific outcomes such as search engine rankings, traffic levels, lead volumes, or revenue increases. Digital marketing results depend on many factors outside our control, including but not limited to market conditions, competition, platform algorithm changes, and client cooperation.

Statistics, metrics, and case studies displayed on this Site reflect actual past client results but should not be interpreted as a guarantee of future performance.

5. Client Responsibilities

When engaging PMC for services, you agree to provide timely access to necessary accounts, platforms, assets, and information. Delays in providing access or approvals may impact timelines and results. You represent that you have the authority to grant access to any accounts or platforms shared with PMC.

6. Payment Terms

Payment terms, rates, and billing schedules will be outlined in your individual SOW. Unless otherwise stated, invoices are due upon receipt. PMC reserves the right to pause or suspend services for overdue accounts exceeding 15 days past due.

7. Intellectual Property

Any original content, strategies, audits, reports, or deliverables created by PMC specifically for a client become the client's property upon full payment. General methodologies, frameworks, templates, and tools developed by PMC remain the intellectual property of PMC.

You may not resell, redistribute, or white-label PMC deliverables without written consent.

8. Confidentiality

PMC treats all client data, analytics, business information, and account credentials as confidential. We will not share your information with third parties without your consent, except as required by law. We expect the same courtesy regarding our proprietary processes and pricing.

9. Third-Party Tools and Platforms

PMC may use or recommend third-party tools, platforms, and services (such as Google Ads, Google Analytics, Webflow, Semrush, etc.) in the course of providing services. PMC is not responsible for the terms, policies, pricing changes, outages, or actions of these third-party providers.

10. Website Use

You agree to use this Site for lawful purposes only. You may not attempt to gain unauthorized access to any part of the Site, interfere with its operation, or use automated tools to scrape or extract content. All content on this Site — including text, images, graphics, and code — is the property of PMC unless otherwise noted.

11. Contact Form and Communications

12. Limitation of Liability

To the maximum extent permitted by law, PMC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this Site or our services. Our total liability for any claim shall not exceed the total fees paid by you to PMC in the six months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless PMC, Joe Pfender, and any affiliated parties from any claims, damages, or expenses arising from your breach of these Terms, your use of our services, or your violation of any law or third-party rights.

14. Termination

Either party may terminate a service engagement with 30 days written notice unless otherwise specified in the SOW. PMC reserves the right to terminate services immediately in cases of non-payment, abusive behavior, or illegal activity. Upon termination, all outstanding fees are due immediately, and access to accounts managed by PMC will be transferred back to the client.

15. Dispute Resolution

Any disputes arising from these Terms or the services provided shall be resolved through good-faith negotiation. If unresolved, disputes will be submitted to binding arbitration in Philadelphia, Pennsylvania, under the rules of the American Arbitration Association. These Terms are governed by the laws of the Commonwealth of Pennsylvania.

16. Modifications

We reserve the right to update these Terms at any time. Changes take effect upon posting to this page. Continued use of the Site after changes constitutes acceptance. We recommend reviewing this page periodically.
